Miss Grant Limited, Trading as Cherubs Jewellery, supplies Jewellery on the following terms and conditions.

1. Introduction The meaning of some words used in these terms and conditions: we', 'us' or 'our' is a reference to Miss Grant Limited Trading as Cherubs Jewellery Company Number SC374054 And have their registered office at 269 Holburn Street, Aberdeen, the supplier of the Jewellery; 'you' or 'your' is a reference to the person to whom we are supplying Jewellery and who is required to pay for the Jewellery we supply; 'Jewellery' means the jewellery and/or gifts and any other items we supply to you and which you pay for.

2. Making an order When you place an order by telephone, email or via the website you are making an offer to buy the Jewellery you have specified at the price stated for those items of Jewellery from us. At this point there is no binding contract between you and us. A binding contract shall come into place when we accept your order by accepting a deposit from you but the title to the Jewellery will remain with us until the price has been paid by you in full. Illustrations, catalogues, photographs, descriptions, samples and general literature relating to the Jewellery are intended as a general guide only and shall not form part of any contract between us and you unless otherwise expressly agreed in writing signed on behalf of us by an official of Miss Grant Limited. For the avoidance of doubt photographs of Items may not depict the actual size of the items and the colour may vary dependant on the display equipment used.

3. Price of Jewellery and Payment We use all reasonable endeavours to display accurate and up to date prices on our website. If an error has been made and the price is displayed incorrectly we reserve the right to withdraw the item from sale. The Payment of the price shall be made in Pounds Sterling (£). The price of any item of Jewellery may change. In the event of a price change we will notify you of the details of any such change as soon as practicable.  Precious metal and Diamond prices fluctuate daily which can influence your final price of bespoke jewellery, wedding rings and engagement rings. If the price is lower then we will charge you the lower price and deliver the Jewellery to you. If the price is higher then we will contact you to ask you either whether you wish to pay the higher price, select an alternative item of Jewellery, or to cancel your order. If you cancel your order then any payment made will be refunded within 14 working days. All prices shown are inclusive of value added tax at the applicable rate at the date of order. (As of the 4th January 2011 the standard rate of VAT is 20%) When you place an order online, by email, in person or by telephone you authorise us to debit the credit, debit or other card you specify on your order for the amount of the order. We will require at least a 35% non-refundable deposit to hold Jewellery for you or to start work on bespoke Jewellery, the balance to be payable when the Jewellery is available for delivery to you. On payment of the balance of the full price the Jewellery will be dispatched to you on a date agreed with you.

4. VIP Privileges Card If you qualify as a VIP privileges cardholder any offers made to you by us may change depending on the availability of items offered. We reserve the right to change the offer/s at anytime and will communicate changes with existing VIP Cardholders as soon as practicable. All current offers made that are relevant to becoming and being a VIP Privileges Cardholder will be displayed on our website headed VIP Privileges Card. 5. Free Gift Offers upon Registration When you register and allow us to contact you we offer you a complimentary jewellery cleaning cloth. We reserve the right to withdraw or change this offer at any time without prior notice. Should the offer item be out of stock at the time of your registration we will notify you with an anticipated delivery time as soon as practicable. This offer is currently withdrawn as of November 2014.

6. Availability and dispatch of Jewellery The range of our Jewellery is as shown online or as displayed by us. We cannot guarantee whether the items of Jewellery you wish to purchase are actually in stock at the time of order. Any times and dates given for dispatch of Jewellery (or the length of time that Jewellery will take to be delivered) are only estimates and are not guaranteed as delivery is made by third party service providers who are not under our control. If we are unable to meet any stated dispatch or delivery dates or times we will inform you as soon as practicable as to the progress of your order. If the delay will be substantial or if the Jewellery will not be available at all for dispatch we will ask you either whether you wish to select an alternative item of Jewellery, or to cancel your order. If you cancel your order then any payment made will be refunded within 14 working days. If you choose alternative Jewellery any consequent refund or additional payment shall be made as soon as practicable.

7. Delivery We make deliveries in the mainland of the United Kingdom, Europe and around the world. We may deliver the Jewellery in one or more installments at our sole option and some of the Jewellery may be delivered directly from the manufacturer of the Jewellery. The Jewellery shall be at your risk as from the date of delivery.

8 Limitation of liability If the items of Jewellery we deliver are not what you ordered or are damaged at the time of delivery or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 7 days of the delivery of the Jewellery in question. If you do not receive the Jewellery ordered by you within 30 days of the date on which you ordered it, we shall have no liability to you unless you use reasonable efforts to notify us in writing at our contact address of the problem within 40 days of the date your order was accepted by us. If you notify a problem to us under this clause 8, our only obligation will be, at our option: A. To make good any shortage or non delivery; or B. To replace or repair any items of Jewellery that are damaged or defective provided that we are satisfied that the damage or defect is not as a result of misuse or mishandling; or C. To refund to you the amount paid by you for the Jewellery in question in whatever way we choose. We will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the Jewellery in question under clause 8.c above. This exclusion does not exclude your statutory rights (see clause 8.d below) You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase Jewellery from our site. The importation or exportation of certain of our Jewellery to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the Jewellery you purchase.

8.d Nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

9. Guarantee We guarantee to repair or replace your Jewellery should there be a defect due to original workmanship within 3 months unless the Jewellery has been accidentally or otherwise mishandled after delivery in which case this guarantee will not apply (though your statutory rights are not affected).

10. Cancellation rights Under UK consumer law you have an unconditional right to cancel the contract within 7 working days of receipt of your goods. Notification of your wish to cancel should be made by you in writing to us by email or letter. Except for your statutory rights and as provided for elsewhere In these terms and conditions you will have no right to cancel your order once it has been accepted by us. Please note that the unconditional right to cancel within 7 working days does not apply to bespoke, sized or personalised Jewellery.

11. Returns or Exchange We cannot accept the return or exchange of items of Jewellery that have been individually commissioned Engraved or personalised but in all other cases if you wish to return or exchange any or all the Jewellery you have purchased please complete the Returns Form that you will receive with your order, and enclose the returns form with the item you wish to return. We can only accept returned goods that arrive in perfect condition, in the same packaging, within 14 days of receipt by you whether purchased online or from our representative provided always that if purchased from our representative we will need proof of purchase by way of till receipts. 12. Invalidity If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

13. Rights of Third Parties This agreement does not give any person who is not a party to it any right to enforce any of its provisions.

14. Law and jurisdiction These Terms and Conditions and your use of our Web Site shall be governed by and construed in accordance with the law of Scotland and you agree to submit to the nonexclusive jurisdiction of the Scottish courts.
